1. HOW TO ENTER: Promotion starts on 6/4/2008, 12:00 a.m. (CT) and ends 8/8/2008, 11:59 p.m. (CT). To enter, visit http://www.momcentral.com/american-standard-heating-air-conditioning/win-an-accuclean.html to access the online registration form. Complete and submit the online entry form. Completed entries must be received by the entry deadline. Limit one (1) entry per person, family or household/homeowner.
2. ELIGIBILITY: Entrants must live within the Boston, Massachusetts, metropolitan area. Entrants must own and occupy the home entered and have an existing heating and air conditioning system. Open only to legal residents of the United States and the District of Columbia, who are 18 years of age at time of entry.
3. DRAWING: One (1) name will be randomly selected by American Standard Heating & Air Conditioning from the completed online registration forms. The odds of winning depend on the number of eligible entries received. The winner will be notified by mail, email and/or phone no later than 8/22/2008.
4. PRIZE: One (1) Grand Prize winner will receive a complete American Standard Heating & Air Conditioning home comfort system, including an American Standard AccuClean air filtration system, installation, and an extended warranty which includes parts and labor for 10 years. Retail value of prize package not to exceed $15,000. Prize consists of only those items specifically listed above as part of the prize. In addition, the first 100 entrants (determined by the time receipt on the online registration) will receive a $10 gift certificate to Amazon.com.
5. GENERAL RULES: Employees of Trane, their affiliates, subsidiaries, advertising and promotion agencies and their immediate family members and/or those living in same household of each are not eligible. Void where prohibited by law. No cash equivalents, substitution or transfer of prize permitted by winner. Sponsor reserves the right to substitute prize of equal or greater value. All federal, state and local taxes are sole responsibility of winner. All federal, state and local laws and regulations apply. No correspondence regarding the contest and random selection of the winning entry will be acknowledged or entered into. Winner must execute an Affidavit of Eligibility/Liability Release, and where permitted by law, Publicity Release within ten (10) days after receipt of first notification attempt. Noncompliance within this time period may result in disqualification in which case an alternate will be selected. By entering the random drawing and/or accepting prize, entrant grants permission to Sponsor and its agencies to use winner’s name(s) and/or likeness, photo(s) and testimonial(s) for purposes of advertising/trade, including right to own, reproduce, alter, amend, edit, publish and use any testimonial, without further compensation to entrant, unless prohibited by law. By accepting prize, winner agrees to hold Sponsor, their respective directors, officers, employees and assigns, harmless against any and all claims and liability arising out of this random drawing and use of the prize. Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or use/redemption of any prize. Entrants agree to be bound by the Official Rules.
Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the program or in the announcement of the prize. The random drawing and all matters relating to this promotion are final and binding. Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry registration, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor or presenter on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof.
If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this contest, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the registration process, and to cancel, terminate, modify or suspend the contest. Caution: Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the random drawing is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such entrant to the fullest extent of the law.
6. DISPUTES: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Competition or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of New Jersey. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Competition, shall be governed by, and construed in accordance with, the laws of the State of New Jersey, without giving effect to any choice of law or conflict of law rules (whether of the State of New Jersey or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New Jersey.
