1. Sponsor: Mom Central, 77 Chapel Street, Newton, MA 02458 (“Sponsor”).
2. Administrator: LeadDog Marketing Group, Inc., 159 W. 25th Street, 2nd Floor, New York, NY 10001 ("Administrator").
3. Sweepstakes Schedule: The Sweepstakes begins on or about at 12:01 a.m. Eastern Time ("ET") on 1/19/10 and ends at 11:59:59 p.m. ET on 2/28/10 (“Promotion Period”). Administrator’s computer is the official clock for the Sweepstakes.
4. Eligibility The View Moms Group Sweepstakes ("Sweepstakes") is open only to legal residents of the 50 United States and Washington D.C., who are at least 18 years of age and who have an active e-mail account and Internet access prior to the beginning of the Promotion Period (as defined below). Employees of Sponsor, Administrator, American Broadcasting Companies, Inc. (“ABC”), any organizations responsible for sponsoring, fulfilling or administering the Sweepstakes or supplying the prizes, persons involved in the creation, development or production (including cast and crew) of The View television show, and/or each of their respective parent, subsidiary, affiliated and successor companies, and immediate family and household members of such individuals, are not eligible to enter or win. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses, regardless of where they live. "Household members" shall mean people who share the same residence at least three months a year, whether related or not. Potential winner may be required to provide proof of eligibility upon request prior to prize award. Void in Puerto Rico and where prohibited or restricted by law.
5. Sweepstakes Entry: To enter, go to http://momcentral.com (the "Website") and navigate to The View Moms Group page or search keywords: The View. Complete the online entry form and submit your sweepstakes entry by clicking the "Submit Entry" button.
All entries become the property of Sponsor and will not be acknowledged. You may be asked to consent to receive promotional e-mails and reminder e-mails from the Sponsor. Consenting to receive promotional or reminder e-mails is optional and does not have to be agreed upon in order to be eligible to participate in the Sweepstakes and does not improve your chances of winning. In the event you do consent to receive these e-mails, the use of such e-mails shall be subject to the privacy policies of Mom Central. You may opt out of receiving these e-mails at any time. See Section 11 below for more information Limit one (1) entry per person/e-mail address. Multiple entries in excess of this limitation or mass entry attempts will result in disqualification of all entries by such person. Entries must be manually key-stroked; use of automated entry devices or programs is prohibited.
6. Random Drawing/Selection of Winner: On or about 3/3/10, the Grand Prize drawing will be conducted by Administrator, an independent judging organization whose decisions are final on all matters related to this Sweepstakes. A potential winner will be selected in a random drawing by Administrator from among all eligible entries received during the Promotion Period.
Potential winner will be notified by e-mail. Failure to respond to the initial verification e-mail within three (3) business days after notification or return of e-mail notification as undeliverable after three (3) attempts will result in disqualification.
Potential winner will then be required to sign and return within five (5) business days (or such shorter time as required by exigencies) an Affidavit of Eligibility, Release and Indemnification, and a Publicity Release (collectively, the "Prize Claim Documents") where allowed by law. If the Prize Claim Documents are not returned to Sponsor within the specified time period, the potential winner will be disqualified. If winner is disqualified, prize may be awarded to an alternate winner randomly selected from all remaining eligible entries. In the event of any dispute concerning the identity of any entrant, the entry will be deemed submitted by the natural person who is the authorized account holder of the transmitting e-mail account at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to the e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Guest of Grand Prize Winner (if a minor, his/her parent or legal guardian) must sign and return a Travel Companion Release prior to issuance of travel documents. If Guest is a minor, he/she may only accompany his/her parent or legal guardian (i.e., the Grand Prize Winner) on the trip.
If for any reason the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical failures beyond Sponsor’s control that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to terminate, modify or temporarily suspend the Sweepstakes. In such event, Sponsor reserves the right to conduct the Sweepstakes and award the prize by means of a random drawing comprised of all eligible entries received prior to and/or after (as appropriate) the action taken by Sponsor or otherwise award the prize in a manner which is fair, appropriate and consistent with these Official Rules, as determined by Sponsor in its sole discretion. No responsibility is assumed for entries that are altered, delayed, deleted, destroyed, forged, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, irregular in any way, late, lost, misdirected, multiple, non-delivered, stolen, tampered with, unauthorized, unintelligible or otherwise not in compliance with these Official Rules; for failed, partial or garbled computer transmissions or technical failures of any kind, including but not limited to, electronic malfunction or damage of any network, hardware or software; for any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment or software; for failure of any e-mail or electronic entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof; for any injury or damage to entrant's or any other person's computer related to or resulting from participation in or downloading any materials from this Sweepstakes; or for other errors of any kind, whether due to electronic, human, mechanical, printing, production or technical errors or other causes; even if caused by the negligence of any of the Released Parties (as defined below). Each of such potential entries will be disqualified.
Entrants further agree not to knowingly damage or cause interruption of the Sweepstakes and/or prevent others from participating in the Sweepstakes. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES VIOLATES CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY ENTRANT MAKING SUCH ATTEMPT AND SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW.
7. Prize, Approximate Retail Value ("ARV") and Odds of Winning:
One (1) Grand Prize Winner will receive a 3-day/2-night trip to New York, NY for winner and one guest (“Guest”) to attend a taping of The View. Trip consists of round-trip coach air transportation to New York, NY from major commercial airport of Sponsor’s sole choosing near Grand Prize Winner’s residence; 2-nights’ standard hotel accommodations (double occupancy) in a hotel of Sponsor’s sole choosing in the New York area; ground transportation between New York airport, hotel and admission for the winner and their Guest to attend a taping of The View. Approx. retail value of prize: $3,500.00.
To attend a taping of The View, winner must travel on specific dates to be determined by ABC in its sole discretion, with the date of travel being tentatively scheduled for Spring 2010 (potential winner will be notified of actual date of travel at time of prize notification). If winner is unable to participate in the trip during the dates designated by ABC, or, if after travel has been booked, taping of The View is postponed or delayed for any reason, winner will receive trip to New York as set forth above but will not receive any substitute or replacement prize for omission of taping of The View. Sponsor and ABC are not responsible for cancellation or preemption of The View or any part thereof or for other circumstances that make it impractical or impossible to fulfill the audience taping element of the Grand Prize. This element of the Grand Prize has no approximate retail value, and if it becomes impractical or impossible to fulfill this element, or if Grand Prize Winner cannot participate in this element of the prize on the dates specified by ABC for any reason, Sponsor’s only obligation will be to provide the remainder of the Grand Prize.
Actual final value of trip may be higher or lower based on point of departure and ticket and hotel availability and cost at time of purchase. If Grand Prize Winner lives less than approximately 150 miles from New York, NY (as determined by Sponsor in its sole discretion), he/she will receive, in lieu of applicable segment of air transportation component of prize, round-trip local transportation between Grand Prize Winner’s residence and hotel and Grand Prize Winner will receive no compensation for such substitution. Grand Prize Winner is solely responsible for all other expenses related to trip not specified herein, including but not limited to meals, beverages, tips, taxes and hotel incidentals. Grand Prize Winner and Guest must travel together on specified itinerary, including same departure date, destination and return date or Grand Prize may be forfeited in its entirety. Accommodation restrictions and blackout dates may apply. All travel dates and arrangements are subject to change, availability and Sponsor’s approval. Sponsors are not liable for any expenses incurred as a consequence of flight cancellation/delay. Certain documentation and requirements may be necessary for travel, such as photo identification. Grand Prize Winner and his/her Guest are solely responsible for any documentation and requirements and determining applicable procedures and restrictions. In addition, the Grand Prize Winner may be required to present a valid credit card at the hotel at the time of check-in. Grand Prize Winner and Guest must provide own transportation to and from departure airport.
No substitution or transfer of prize except with Sponsor’s permission or where required by law. If for any reason announced prize becomes unavailable, Sponsor in its sole discretion may award a substitute prize of equal or greater value. Prize will only be delivered to address within the United States. Federal, state and local taxes are the sole responsibility of the winner, who will receive a 1099 tax form reflecting actual value of any prize valued at $600 or more. Sponsor may disqualify any individuals who attempt to tamper (or who do tamper) with the entry process, violate these Official Rules or act in a disruptive or abusive manner. Sweepstakes available to over 100 million Internet users. Odds of winning a Grand Prize depend on total number of eligible entries received during the Promotion Period.
8. Conditions and Limitations of Liability: By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of Sponsor, which shall be final in all respects. By participating in this Sweepstakes, entrants agree to release and hold harmless Sponsor, Administrator, ABC, and each of their respective parent, subsidiary, affiliated and successor companies, advertising and promotion agencies and prize suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the "Released Parties") from and against any and all claims or actions of any kind, including but not limited to any claim related to entrants’ submission of an entry, entrants’ participation in the Sweepstakes, or for property damage, product liability, wrongful death or personal injury arising out of or relating to possession, acceptance, receipt or use/misuse of the prize, whether under contract, tort or any other legal theory, and agree to indemnify the Released Parties against any liability or expense (including reasonable attorneys’ fees) arising in connection with the foregoing.
By entering, entrants also authorize the Released Parties to use their name, voice, likeness, photograph, prize information, biographical data and city and state of residence in programming or promotional material or on a winner's list (if applicable) without further compensation unless prohibited by law. Sponsor is not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor’s sole discretion, without further obligation or compensation. All entries become the property of Sponsor and will not be acknowledged.
9. Winner’s List: For winner’s name, mail a self-addressed, stamped envelope to “The View Moms Group Sweepstakes”, c/o LeadDog Marketing Group, 159 W. 25th Street, 2nd Floor, New York, NY 10001 by 3/1/10.
10. Disputes: Arbitration/Choice Of Law: Except where prohibited, entrants agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or any prize awarded, or the determination of the winners, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of the American Arbitration Association, then effective, and (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and/or Released Parties in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, without regard for conflicts of law doctrine of New York or any other jurisdiction, and all proceedings shall take place in the City of New York, County of New York.
